@Pnaky, is it possible to revise that even if its old?
Its cool looking and I perhaps liked it enough that I overlooked the gradients.

So you did or did NOT use the gradient tool? Because when you say " I count all pixels for gradient and in photoshop made palette..." and count the colors in total of the piece, which is about 95 colors, I don't quite believe that  a person would choose that many colors manually for piece with simple designs as this. Not to mention, I know photoshop has a gradient tool for text. Now did you mean you chose 1 or 2 blue colors, and let the gradient tool do it's job? That sounds believable, but still not allowed on the website. Again I need more clarification, as this piece is definitely starting to raise my eyebrow.

It seems like gradient tools were used in the text of this piece. If this is the case, then it will probably be sent back for revision, even if it was for a cell phone game...Can you explain this?
